Restitution
Restitution is paid to victims of crime, pursuant to orders of the court. The Pre-sentence Investigation Report writer prepares a Restitution Ledger for the court, providing the amounts recommended to be paid and victim addresses. Victim address information is entered on to an automated system from the Restitution Ledger. The Ledger is not filed into the court record; victim address information is maintained as confidential.
When payment is received, it is posted, allocated and disbursed pursuant to the court's order. Restitution checks all carry a reminder to the victim to always update their address information with the Clerk's Office. The Clerk's Office conducts an exhaustive search to locate victims where payment has been returned due to a bad address. Following a brief period of time, any funds remaining unclaimed by victims, is transferred to the Arizona Department of Revenue, pursuant to Arizona Revised Statutes relating to unclaimed property.
